Surprisingly, some people file the paperwork to obtain a divorce, but never finalize the divorce. The parties believe that they are divorced, but their legal status is “married.” Sometimes, those same people remarry not realizing that their earlier divorce was never finalized and they are still married to their previous spouse. Usually the circumstance can be rectified through the proper procedure. However, there are times when the second spouse can use the situation to nullify the current marriage. It is important in every divorce to review the judgment papers to determine if the marriage has been dissolved.
