Mueller v. Mueller is a divorce that was decided in 1956 and concerns the good will of a business.
Before the parties were married, the husband purchased a dental laboratory business. The value of the business increased substantially during the marriage.
The trial court awarded the business to the husband and required him to pay the wife half of the value of the business including half of the good will value. The husband appealed the trial court’s decision stating that dentistry is a professional practice that depends on the personal skill and ability of an individual and cannot be the subject of good will.
The appellate court agreed with the trial court and stated that although it was previously held that good will cannot exist in a professional business, the better doctrine is that good will does exist in professional practices.
