The Domestice Violence Prevention Act

The Domestic Violence Prevention Act allows a family court to make orders for restitution when a victim of domestic violence has suffered injury. California Family Code section 6342(a)(1) allows a family court judge to issue an order for restitution for any damages suffered as a result of the abuse inflicted by an abuser. The code allows damages for loss of earnings and out-of-pocket expenses including medical expenses and housing expenses. It also allows an order for restitution for any actual physical injuries. If ordered to pay restitution, the abuser will have to make those payments to the victim for his or her losses.
