One of the issues that couples may need to address in a divorce is the validity of the marriage. In California five steps are required for a couple to enter into a valid marriage: (1) both parties must consent, (2) they must obtain a marriage license, (3) they must enter into vows to solemnize the marriage, (4) the person who administers the vows in the marriage ceremony must authenticate the marriage by signing the marriage license with at least one witness signing the license, and (5) the person who solemnizes the marriage must return the certificate of registry to the county clerk. If one or more of these items are not completed, then the parties may not have entered into a valid marriage.
